Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Bold Asset Interior Design Education ("Company," "we," "us," or "our") regarding your use of our website, educational services, and related offerings.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services. These Terms apply to all visitors, users, and others who access or use our services.

2. Description of Services

Bold Asset Interior Design Education provides educational services focused on the history and evolution of interior design in Canada. Our services include:

  • Online and in-person courses covering classical to contemporary design movements
  • Professional consultation and mentoring services
  • Certification programs in interior design history
  • Educational resources, articles, and research materials
  • Workshop and seminar programs
  • Digital learning platforms and tools

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. User Accounts and Registration

3.1 Account Creation

To access certain features of our services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

3.2 Age Requirements

You must be at least 13 years old to create an account. Users between 13 and 18 years old must have parental or guardian consent. Users under 18 may have limited access to certain services.

4. Course Enrollment and Completion

4.1 Enrollment Process

Course enrollment requires payment of applicable fees and acceptance of course-specific terms. Enrollment confirmation will be provided via email.

4.2 Course Access

Access to course materials is granted for the duration specified in your enrollment. Online courses typically provide 12-month access from enrollment date unless otherwise specified.

4.3 Completion Requirements

Certificate issuance requires completion of all mandatory course components and achieving minimum passing grades as specified in course materials.

4.4 Course Changes

We reserve the right to modify course content, schedules, and instructors. Material changes will be communicated with reasonable advance notice.

5. Payment Terms

5.1 Fees and Pricing

Course fees and service charges are clearly displayed on our website. Prices are subject to change without notice, but changes will not affect already purchased courses.

5.2 Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed during checkout. All payments are processed securely through third-party payment processors.

5.3 Refund Policy

Refunds are available under the following conditions:

  • Full Refund: Within 14 days of purchase if less than 20% of course content has been accessed
  • Partial Refund: Pro-rated refunds may be available for courses cancelled by the Company
  • No Refund: After course completion or certificate issuance
  • Special Circumstances: Refunds may be considered for medical emergencies or other exceptional circumstances

5.4 Late Payments

Overdue payments may result in suspension of service access. Payment plans, if available, are subject to separate agreements.

6. Intellectual Property Rights

6.1 Company Content

All course materials, website content, trademarks, logos, and other intellectual property are owned by Bold Asset Interior Design Education or our licensors. This includes:

  • Course videos, audio recordings, and presentations
  • Written materials, handouts, and digital resources
  • Website design, graphics, and software
  • Proprietary educational methodologies
  • Company name, logos, and branding materials

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use course materials solely for personal educational purposes. You may not:

  • Reproduce, distribute, or share course materials
  • Create derivative works or modifications
  • Use materials for commercial purposes
  • Remove copyright or proprietary notices
  • Reverse engineer or attempt to extract source code

6.3 User-Generated Content

By submitting content to our services (comments, assignments, forums), you grant us a non-exclusive, royalty-free license to use, modify, and display such content for educational and promotional purposes.

7. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Illegal Activities: Using our services for any unlawful purpose or in violation of applicable laws
  • Harassment: Harassing, threatening, or discriminating against other users or staff
  • Spam and Solicitation: Sending unsolicited communications or promotional materials
  • Intellectual Property Violation: Infringing on copyrights, trademarks, or other proprietary rights
  • System Interference: Attempting to interfere with or disrupt our services or security
  • False Information: Providing false, misleading, or fraudulent information
  • Account Sharing: Sharing login credentials or allowing unauthorized access to your account

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Uninterrupted or error-free service
  • Accuracy, completeness, or reliability of content

9.2 Limitation of Liability

To the maximum extent permitted by law, Bold Asset Interior Design Education shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities

  • Cost of substitute services
  • Personal injury or property damage

Our total liability for any claim arising from these Terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

9.3 Educational Outcomes

We do not guarantee specific educational outcomes, job placement, or professional advancement as a result of completing our courses.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bold Asset Interior Design Education, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

  • Your violation of these Terms
  • Your use of our services
  • Your violation of any rights of another party
  • Any content you submit or share through our services

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting our customer service. Termination does not automatically entitle you to a refund.

11.2 Termination by Us

We may terminate or suspend your access to our services immediately, without prior notice, if:

  • You breach these Terms
  • You engage in prohibited activities
  • We determine termination is necessary for legal or business reasons
  • Your account remains inactive for an extended period

11.3 Effect of Termination

Upon termination, your right to access and use our services will cease immediately. Provisions that by their nature should survive termination will remain in effect.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts located in Montreal, Quebec, Canada.

12.3 Mediation and Arbitration

Before pursuing formal legal action, parties agree to attempt resolution through mediation. If mediation fails, disputes may be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association.

13. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, or technical failures.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. We will notify users of material changes through:

  • Email notifications to registered users
  • Prominent notices on our website
  • In-service notifications

Your continued use of our services after changes indicates acceptance of the modified Terms.

17. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and Bold Asset Interior Design Education regarding your use of our services and supersede all prior agreements and understandings.
